MEMAHAMI KONSEP MAQĂŞID AL-SYARI’AH DALAM FILSAFAT HUKUM ISLAM

Maqāşid al-syari’ah is target and meaning desired by syara’ in specifying or  it all or most his lawses, or target oves and specified secret God in each God law. Thus, Maqāşid al-syari’ah is existing secret and target and desired God in specifying, ad for as a whole and some of laws of God. Target of syari’ah, at the core of is to look after kindliness of human being and obviate badness, either in world and in eternity/the beyond.

Theory of maqāşid al-syari’ah, becoming fulcrums the core important is kindliness of human being in eternity/the beyond and world. Membangun masyarakat madani dalam era demokrasi

Demokrasi merupakan tuntunan zaman dan menjadi unsur utama yang membentuk manusia pada saat ini. Manusia sebagai warga masyarakat yang mempunyai hak-hak demokrasi terutama hak untuk memilih, berpikir, berekspresi, mengeluarkan pendapat, berkumpul, beror-ganisasi, mendapatkan pendidikan, pekerjaan, kesetaraan, persamaan kesempatan dan sebagainya. Rakyat merupakan pemegang kekuasaan, pembuat dan penentu keputusan dan kebijakan tertinggi dalam penyelenggaraan negara dan pemerintahan serta pengontrol terhadap pelaksanaan kebijasanaan, baik yang dilakukan secara langsung oleh rakyat atau yang mewakili melalui lembaga perwakilan. Oleh karena itu, negara yang menganut sistem demokrasi diselenggarakan berdasarkan kehendak dan kemauan rakyat mayoritas dengan tidak mengesampinkan kaum minoritas.

KEKERASAN TERHADAP PEREMPUAN: PERSPEKTIF PEMIKIRAN AGAMA DAN SOSIOLOGI

Abstract: Talking about violence, including violence against women is actually talking about social relations in the long span of human history. Violence against women has been done and manifested in various forms, emerging from social, cultural, economic, and political status and even it was done in the name of religion in all levels of society.  Social relationships and religious understanding often triggered violence against women. Through sociological and religious perspective, this study tried to explore violence against women which had happened in various public places. In the perspective of religion,Islam has taken a similar position as regards both women and men and their rights should be the same and the identical because Islam brings the mission of equality to the world, and the difference lies only in the presence of piety and devotion to God. In the perspective sociology, both men  and women are actually in a balance position. The paradoxical happening of violence against women in the two aspects of knowledge had caused the feminism movement that did not only try to inforce justice and equality between men and women but also tried to reconstruct the role and function of women in order to achieve ‘ideal social order’ for the sake of the ideas of equality and justice. At least there should be a movement of feminism which is basically as the transformation of women’s movement that aims to create better relationship between men and women.

الملخص :إن الحديث عن “العنف” وفيه عن العنف تجاه المرأة حديث عن العلاقة الإجتماعية عبر تاريخ الإنسان. ظهر العنف تجاه المرأة في شتّى الأشكال، ظهر من الناحية الإجتماعية، والثقافية، والإقتصادية، والسياسية بل على أساس الدين في جميع مستويات المجتمع. والعلاقة الإجتماعية والفهم الديني أصبحا – كثيرا ما – مسببا لفعل العنف تجاه المرأة. حاولت هذه الدراسة – بوجهة النظر الإجتماعي الديني – دراسة ظاهرة هذا العنف في كثير من المجتمعات. إن الإسلام لا يفرّق بين كنه الرجل والمرأة. والفرق والتفوّق بينهما كانا في التقوى. وفي الناحية الإجتماعية فإن الرجل والمرأة متساويان متوازيان . فوقوع التعارض وهو العنف تجاه المرأة في العلمين يؤدّى إلى ظهور الحركة النسائية حاولت – ليس فقط –  إقامة العدل والمساواة بين الرجل والمرأة، بل إعادة بناء الفكرة عن دور ووظيفة المرأة  للحصول على النظام العادل للآراء عن العدل والمساواة.  وعلى الأقل لابد من وجود الحركة النسائية كحركة إصلاحية للنساء لتكوين العلاقة الأحسن بين الرجل والمرأة.

Abstrak: Membincang kekerasan termasuk kekerasan terhadap perempuan sejatinya membincang relasi sosial dalam rentang panjang sejarah umat manusia. Kekerasan terhadap perempuan menampakkan diri dalam beragam bentuk, muncul dari ranah sosial, budaya, ekonomi, politik bahkan dari dan atas nama agama dalam semua tingkatan masyarakat.Relasi sosial dan pemahaman keagamaan acapkali menjadi pemicu kekerasan terhadap perempuan. Melalui perspektif sosiologis dan agama, kajian ini berusaha untuk mengeksplorasi kekerasan terhadap perempuan yang muncul dalam beragam entitas masyarakat. Dalam ranah agama, Islam sejatinya memandang bahwa tidak ada distingsi antara laki-laki dan perempuan karena ia (Islam) membawa misi kesetaraan, parameter distingsi hanyalah ketaqwaan kepada Tuhan..Dalam ranah sosiologis, semua manusia baik laki-laki maupun perempuan sejatinya berada pada posisi yang seimbang. Terjadinya paradoks berupa kekerasan terhadap perempuan dalam dua ranah keilmuan ini memunculkan gerakan feminisme yang tidak saja mencoba untuk menegakkan keadilan dan kesetaraan antara laki-laki dan perempuan tetapi juga berusaha untuk merekonstruksi peran dan fungsi perempuan demi tercapainya tatanan yang ‘ideal’ bagi ide-ide kesetaraan dan keadilan.Paling tidak harus ada gerakan feminism yang notabene merupakan gerakan transformasi bagi perempuan yang bertujuan untuk menciptakan relasi laki-laki dan perempuan kea rah yang lebih baik.

Paham Qadariyah dan Jabariyah pada Pelaku Pasar Pelelangan Ikan Bajo di Kabupaten Bone, Provinsi Sulawesi Selatan

This research applies descriptive method for describing or explaining a problem and phenomenon which exist until now. The issues discussed in this research are:

1). How is society’s view on Qadariya and Jabariya doctrines? 2). How is the role of Qadariya and Jabariya theology towards society at Bajo Fish Auction market? This result concludes that based on Islamic perspective, human deeds are interpreted into viewpoints. Human beings have a freedom and desire to do some deeds that they want. They create their deeds. It is called Qodariya doctrine. Conversely, the second group’s view point is different. They think that human beings cannot make their own deeds but God can make them. For this group, man cannot do anything, they dont have the power to do anything because they are controlled by God. Their thought is called Jabariya. Some societies of Bajo fi sh auction market agree to one or both of them to view those doctrines. Some of them also have different point of view towards those doctrines.

Wacana Demokrasi dalam Pemikiran Politik Islam

This article talks about democracy concept and it relationship to religion which is concept and a means value system is extremely important in the human life. The problem is between Islam as the conviction based on divine revelation and democracy that is product of human reason as social creature. Side long, Islam actually is the initiator in political system application that very appreciate humanity and on the other side democracy system appreciated as the most appreciating system about humanity, so that almost entire government in the world include most of Islamic state accept this system. This democracy system is still in process and its fluency dependent on three component within the state, they are political will from the state, strong commitment from the political society, and strong guidance from civil society to bring the democracy system into reality. For the Muslim, this socialization will be more effective when it also done through religion approach, by the translation of that democracy ideas into religiouslanguage, and integration between it and learning of Islamic religious discipline that discuss about constitutional.

THE BAND OF ABDUL QAHHAR MUDZAKKAR: Biographical Sketch of Rebelious Leaders of Islamic State-Indonesian Islamic Army (DI/TII) of Sulawesi

The rebellious movement of Islamic State-Indonesian Islamic Army (DI/TII) began from dissa­tis­faction towards the secular state of newly indepen­dent Indonesia. Abd. Qahhar Mudzakkar, the leader of DI/TII in Sulawesi and his followers revolted against the govern­ment, and subsequently formed their own Islamic government. Since Qahhar graduated from Muhammadiyah school, his theological basis in his cause to establishing an Islamc state is very prevalent. He believed that his Islamic state is to uphold the truth and to defend the religion of Allah. Thus whoever opposed his DI/TII movement would be considered infidel simply because of favoring or supporting the Indonesian government they considered secular and communist. His followers and supporters were preachers and clerics, who helped Qahhar by carrying out specific functions and positions in his Islamic state. In addition, those people played an important role in getting recognition and acceptance of Sulawesi muslim society for Islamic state campaign launched by Abdul Qahhar Mudzak­kar. Without their involvement, DI/TII would never had been so popular among muslim community in Sulawesi.
